[Michlib-l] Unvaccinated Staff

Hi,

We talked with our labor attorney (Mike Blum) at Foster Swift, because it
seemed so vague and confusing to us after reading the OSHA rules, which
say: * "most employers no longer need to take steps to protect their
workers from COVID-19 exposure in any workplace, or well-defined portions
of a workplace, where all employees are fully vaccinated. Employers should
still take steps to protect unvaccinated or otherwise at-risk workers in
their workplaces, or well-defined portions of workplaces. 2

seemed to be that OSHA was saying *if all employees are vaccinated,* then
yay, everyone can go maskless in the workplace, but if they are not all
vaccinated, then the employer still has to take steps to protect the
unvaccinated. Somehow. Further down their rules, they say employers should
provide unvaccinated workers with masks...so that looked to us like the
unvaccinated staff still needed to mask, and our lawyer agreed. That's what
we're doing, but actually almost the entire vaccinated staff are still
masking anyway. As soon as our area goes up to "substantial" infection
rates, we'll begin requiring all staff to mask who aren't already.
 Sigh....
