Hello Joelle:

It is likely that unless a library has a pretty broad policy, they would have to purchase additional coverage to cover certain LoT items.  Considering a liability waiver is a smart idea – but remember that minors under 18 cannot contract, so unless you are prepared to obtain signed waivers from parents/guardians for all minor patrons who borrow LoT, you may wish to restrict your LoT collction to adult borrowers only and require they sign a good general waiver to borrow anything.

It is a good idea for you to consult your library attorney to ensure that the waiver language is a good fit for your library and the LoT collection you have.

I will send you some examples, but samples are not a good substitution for advice from your lawyer.

Hi Clare,

I was curious to know if libraries get specific insurance for their Library of Things collections? I was told by my insurance agent that we would not be covered if we lend "dangerous non-traditional" items such as tools, kayaks, etc.

I reached out on the director's listserv and I only had one Director respond back saying that they did not get extra coverage. In fact, Niles Public Library only has a policy and a liability waiver for their LoT collection, which I anticipate having too.

I was also wondering if you had a general liability waiver that other places use?
